Common Law marriages are actually called informal marriage in the State of Texas.
The Texas Family Code is available on-line.
Section 2.401 covers informal marriages or common law marriages in Texas.
Remember: You have 2 years from the time you separate to file for divorce and easily claim a common law marriage existed.
After 2 years, it is rebutably presumed that the parties did NOT enter into an agreement to be married.
